Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed by consumers and businesses through our online store at good-smokes.de, operated by The Good Smokes Co., Kolonnenstr. 8, 10827 Berlin, Germany.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

The version of these Terms and Conditions valid at the time of placing the order shall apply.

2. Contract Formation

The presentation of products in our online store does not constitute a legally binding offer, but rather a non-binding invitation to place an order (invitatio ad offerendum).

By submitting an order, you make a binding offer to purchase the products in your shopping cart. The confirmation of receipt of the order, sent immediately after placing the order by automated email, does not yet constitute acceptance of your offer.

The contract is concluded when we send a shipping confirmation or deliver the goods.

3. Prices and Payment

All prices shown are final prices in euros and include the applicable statutory value-added tax. Shipping costs are displayed separately and are borne by the customer unless otherwise stated.

The available payment methods are shown during the checkout process. Payment is due upon completion of the order.

4. Shipping and Delivery

Delivery is made to the delivery address provided by the customer. Delivery times and shipping costs are indicated on the respective product page and during the checkout process.

Unless otherwise agreed, delivery is made within Germany. Shipping costs for international deliveries are shown separately during the checkout process.

If a product is temporarily unavailable, we will inform you promptly and refund any payments already made without delay.

5. Retention of Title

The delivered goods remain our property until full payment has been received.

6. Right of Withdrawal

If you are a consumer within the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. For full details, please see our Right of Withdrawal page.

7. Warranty

The statutory warranty rights apply. In the event of defects in the delivered goods, you are entitled to the statutory warranty claims against the seller.

8. Liability

We are liable without limitation for intent and gross negligence. For slight negligence, we are only liable in the event of a breach of material contractual obligations (cardinal obligations) and only for foreseeable, contract-typical damages.

The above limitations of liability do not apply to damages arising from injury to life, body, or health, or to claims under the Product Liability Act.

9. Age Restriction

Our product range is exclusively aimed at persons of legal age (18 years and older). By placing an order, you confirm that you have reached the age of 18.

11. Governing Law and Dispute Resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If any individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
